Atlanta police and the Internal Revenue Service are investigating a tax fraud case.
Dana Smith said she waited a year to get her 2011 tax return. Smith said she filed her return with Advanced Tax Services at 903 Martin Luther King Blvd.
Smith said she received a letter from Advanced on March 6 stating the office finally had her check. When she went to pick it up, Smith said the owner, Cheryl Singleton, told her someone already picked up Smith's check for almost $4,000.
"How could my money just walk away like this?" asked Smith.
Smith said it took the IRS over a year to approve her 2011 tax refund because she was the victim of identity fraud. Now, Smith said she is a victim of tax fraud.
"When Cheryl got on the phone, she told me there was a young lady who came in the office with an ID and the addresses matched mine so they gave her the money," said Smith.
A CBS Atlanta News crew went to the Advanced Tax Service on Martin Luther King Boulevard. A woman there would not tell the crew where they could find Singleton. She did call Singleton and told her the news crew was there.
"The news reporter is here for the incident with Dana. Do you want me to call the police because this is really ridiculous, for real," said the employee, who would not identify herself.
CBS Atlanta News found out Singleton owns another Advanced Tax office on Campbellton Road. The crew went there looking for her. Singleton was not there either.
We checked the Secretary of State's website to find out if Singleton has any other businesses registered in her name. She does, a seafood place on Sylvan Road, and that's where CBS Atlanta News found her.
When reporter Tony McNary went inside KM New Orleans Seafood and asked for Singleton, she came out, saw the CBS Atlanta News truck, ran back to the back and told her employees to lock the doors.
McNary called Singleton on her cell phone and asked her about Smith's refund check.
"You can contact the Atlanta Police Department to get some information. This is an active case," said Singleton. "I can't comment about it."
