As the U.S. Supreme Court gets ready to consider whether or not California's Proposition 8 is legal, an Emory law professor filed a brief on behalf of two NFL players who are marriage equality advocates.
Timothy Holbrook is both an attorney and associate dean of faculty at Emory. He said he's filed a brief on behalf of Minnesota Vikings punter Chris Kluwe and Baltimore Ravens' linebacker Brendon Ayanbadejo, who are both vocal gay marriage advocates.
"The court always entertains briefs from other parties who have some sort of interest in the outcome of the case," Holbrook said. "Their point is that - particularly in professional sports, team sports - there really aren't any openly gay professional athletes. Anyone who is openly gay comes out after they retire. Their thought is that shows there is some sort of problem."
The 20-page brief cites articles covering gay athletes who have come out after going into retirement, and articles that talk about homophobia within the professional sports world.
"There is sort of this heightened homophobic atmosphere that can pervade professional sports, their thought is we need to take steps to eliminate that sort of prejudice," Holbrook said. "In their view, denying marriage equality is not legitimate. There's no harm in allowing people to get married."
