DEKALB COUNTY, GA (CBS ATLANTA) -
DeKalb County Board of Education filed a lawsuit and requested a temporary restraining order against the State Board of Education on Tuesday.
Board members want to stop the state from meeting Thursday and possibly requesting Gov. Nathan Deal from removing board members.
In the suit, board members say it is unconstitutional to seat appointed, not elected, BOE members.
They also claim the possible action creates an unconstitutional and unprecedented new process for the removal of elected school board members from office without any showing of misconduct or lack of qualifications.
