Attorney David Walbert represents Fulton County as it fights allegations from Secretary of State Brian Kemp's office.
"I can't say why the secretary of state is doing this. I used to represent the secretary of state and never have charges been brought where the same exact thing has happened in other counties in Georgia, in the last 35 years I'm familiar with, for the kinds of things Fulton County is being criticized for and that's a fact," said Walbert.
Kemp said his office is investigating problems Fulton County voters experienced during the presidential election.
"Obviously, we had a lot of problems that date back to the primaries and previous elections before that," said Kemp.
Some 11,000 voters cast provisional ballots in the November election. In a letter to Fulton County, Kemp said some voters cast two votes.
"The essential issue is when they were at the original polling place, they determined they wanted a provisional ballot, then decided they wanted to change their mind.
"The poll worker should have spoiled the certificates themselves. Their failure to do so had the certificates in the provisional materials," said Sharon Mitchell, interim director of Fulton Elections and Registrations.
The state also claims Fulton County hindered its investigation by withholding documents.
"Most of their conclusions were pretty far off base, in terms of the facts. We're now developing a detailed response to those. We will submit those as quickly as we can to the state election board and to the county commission to show what the truth is," said Walbert. "The investigator presented a number of allegations that we had not been privy to before. Ms. Mitchell and staff produced some 20,000 documents. They picked through about seven or eight of those."
