Georgia law: Rethink that social media post! Ballot photos illegal
ATLANTA (CBS ATLANTA) -
For some of us, posting photos on Twitter or on Facebook is a part of a daily routine. But did you know posting a photo of your completed ballot is illegal in Georgia?
According to Citizen Media Law Project, the rules vary in each state.
Georgia Code 21-2-413 specifically prohibits the use of photographic or cellular devices while "within the enclosed space in a polling place."
According to the Citizen Media chart, the state of Delaware doesn't seem to prohibit snapping pictures at the polls.
Alabama: Voters may not take photos or videos inside the polling place.
Florida: The state expressly prohibits photography inside a polling room.
Georgia: No elector shall use photographic or other electronic monitoring or recording devices or cellular telephones while such elector is within the enclosed space in a polling place.
South Carolina: The South Carolina poll managers' handbook cites a request not to use cameras in the polling place.
North Carolina: No person shall photograph, videotape or otherwise record the image of any voter within the voting enclosure, except with the permission of both the voter and the chief judge of the precinct.
Kentucky: You cannot record the identity of voters within the voting room.
