Newton County's Board of Education will discuss Tuesday whether or not to renew Challenge Charter Academy's charter.
Recently, board members signed a resolution requesting that voters oppose the constitutional amendment relative to the state approval of charter schools.
The amendment that is causing such a stir asks: "Shall the Constitution of Georgia be amended to allow state or local approval of public charter schools upon the request of local communities?"
State School Superintendent John Barge released a statement recently also opposing the amendment.
Barge said it could threaten funding for regular public schools.
On Monday, parents file suit against 180 school districts on the charter amendment.
The parents and taxpayers are represented by Attorney Glenn Delk.
According to Delk, State Supt. John Barage issued a press release with anti-amendment material. He used state resources to disseminate the material to all the school districts and posted the materials on the official DOE website.
Gwinnett County Public School Superintendent J. Alvin Wilbanks released a statement about the lawsuit on Tuesday.
"In providing information to the public regarding Amendment 1, I have done nothing wrong or improper. These lawsuits are simply another attempt to bully, intimidate, and silence the citizens and public servants who are trying to clarify the amendment in order to counter the misleading language of the preamble and the ballot question itself. This is not a partisan issue. Educating voters on Amendment 1 is so important that people from all political parties are collaborating to ensure voters have full and accurate information about it. That said I fully understand and abide by what legally I can and cannot do regarding the use of public funds in this effort. I also know that as an American citizen I have freedom of speech rights that are protected by the United States Constitution. I fully intend to continue exercising those rights, regardless of the tactics employed to try to keep me quiet."
