Driver won't be charged for striking pedestrian in northwest Atlanta

ATLANTA (CBS ATLANTA) -

A driver who struck a woman late Wednesday night on Joseph E. Boone Boulevard won't be charged in the incident, police said.

Atlanta Police Capt. Adam Lee III said investigators determined the 35-year-old woman was not in a crosswalk when she was struck just before midnight, and so the driver was not at fault.

The woman will be cited on a "pedestrian in the roadway" charge, the police term for jaywalking.

The driver of the vehicle remained on the scene until police arrived. The woman was taken to Grady Hospital in stable condition.
