Sheriff-elect Victor Hill
CLAYTON COUNTY, GA (CBS ATLANTA) -
Clayton County Sheriff-elect Victor Hill was expected in court Monday, but was excused by the judge.
His attorneys asked a judge to throw out a 37 count criminal indictment, saying there was no proof that he personally profited from his public office.
Hill won the democratic runoff against incumbent Sheriff Kem Kimbrough despite facing a 37-count criminal indictment.
The charges against Hill stem from his time as sheriff of Clayton County from 2004 to 2008.
He faces charges of racketeering, witness tampering and several others.
If Hill is convicted, he will be barred from taking office.
The judge is expected to make a decision on the defenses motions in the next 10 days.
