Did police botch Andrea Sneiderman investigation?

DEKALB COUNTY, GA (CBS ATLANTA) -

Prosecutors have accused Andrea Sneiderman of planning the murder of her husband, but now there's concern that police may have botched the investigation.

Sneiderman's husband, Rusty, was shot and killed outside of a Dunwoody daycare in November 2010.

Andrea Sneiderman's former boss, Hemy Neuman, was already convicted in his murder, but prosecutors said she was in on the plot.

Sneiderman was arrested Aug. 2 and the following day she was indicted on charges of murder, attempted murder, racketeering, insurance fraud, perjury and making false statements.

But apparently crucial evidence was not collected at the time of the crime.

Prosecutors said investigators didn't act fast enough to secure thousands of text messages and e-mails between the killer and Andrea before the murder.

Legal experts are talking about the case.

"Text messages can be very important, especially looking at the content of the messages. If there's anything incriminating in those messages it's going to be crucial evidence," said former prosecutor Al Dixon.

The DeKalb County District Attorney's Office filed a notice that it is seeking life without parole for Sneiderman on Tuesday.

Two of her attorneys, J. Tom Morgan and John Petrey, maintain that she is innocent.

"We deny it, we absolutely deny it," Petrey said. "She was not the manipulator, she has nothing to do with this. She was victimized by her husband's being murdered in cold blood by Hemy Neuman, and we absolutely deny each and every one of these charges."

Sneiderman has a bond hearing set for Aug. 21.
