HALL COUNTY, GA (CBS ATLANTA) -

A boater facing homicide charges in a deadly collision on Lake Lanier has been released from jail on bond.

Paul J. Bennett, 44, of Cumming was scheduled to appear in Hall County Magistrate court Monday, but waived his first appearance.

Last week, a Hall County grand jury indicted Bennett in connection with the June 18 collision that killed 13-year-old Griffin Prince and his 9-year-old brother, Jake, both of Buford.

Bennett initially bonded out of jail June 19. He was re-booked into the Hall County Jail on Friday.

Bennett's charges included first-degree homicide by vessel, boating under the influence and refusing to surrender aid, according to the indictment.

Police said Griffin was thrown overboard after Bennett's boat slammed into the boat in which he was riding. His body was recovered from the lake by divers 10 days after the accident. Jake was killed at the scene of the crash.

Bennett was released Monday afternoon after posting a $50,000 bond.
