Attorneys for Hemy Neuman, the man convicted of murdering Rusty Sneiderman outside his son's daycare center in 2010, say their client will cooperate with prosecutors in their case against the victim's widow.
Andrea Sneiderman was arrested and indicted Thursday in connection with her husband's death.
Sneiderman's late husband, Rusty Sneiderman, was killed in November 2010, moments after he had dropped off his son at Dunwoody Prep.
Neuman, Andrea Sneiderman's former boss at General Electric, admitted to the murder. In March, a jury found him guilty but mentally ill. He is now serving life in prison without the possibility of parole.
During the trial, both the prosecution and defense said Neuman and Andrea Sneiderman were having an affair. She repeatedly denied that accusation.
Thursday morning, a grand jury met at 8:30 a.m. to listen to the presentation of evidence in Andrea Sneiderman's case. The grand jurors deliberated for about an hour before handing up the indictment.
The indictment included eight counts: violation of the Georgia Racketeer Influenced and Corrupt Organizations Act, criminal attempt to commit murder, malice murder, insurance fraud, two counts of making a false statement and two counts of perjury.
According to the indictment, Neuman and Andrea Sneiderman conspired to kill Rusty Sneiderman so they could receive his $2 million life insurance policy as well the $900,000 he had in his bank account. Prosecutors said the pair wanted to get rid of Neuman's debt so they could enjoy a happy life together.
The indictment also alleged that Andrea Sneiderman attempted to commit murder by giving Neuman her husband's schedule so that he could kill him on Nov. 10, 2010.
"Anyone that aides, abets, encourages, conspires, participates has the same culpability as the individual that is charged," said District Attorney Robert James. "In layman's terms, if you help, you can be charged like the person that did it."
The indictment says Andrea Sneiderman lied to police investigators immediately after her husband's murder. It alleges she also lied during testimony at the Neuman trial.
Andrea Sneiderman was held at the DeKalb County Jail without bond. During a news conference on Thursday afternoon, James said he would ask a judge that bond be denied for her.
"We're going to put our best foot forward," James said. "We're going to put all the facts and the evidence out there. At the end of the day, it's going to be up to a jury to make a decision."
Thursday afternoon, J. Tom Morgan, a former DeKalb County district attorney and one of the members of Andrea Sneiderman's defense team, said that his client was surprised and shocked that she was arrested.
"Obviously she is in a state of shock right now," Morgan said. "She was arrested with her children in the home with her. She was not even allowed to say goodbye to her children."
An attorney for Rusty Sneiderman's family said they would not be commenting on the indictment.
