ATLANTA (CBS ATLANTA) -

Another Atlanta Public School teacher who fought to keep her job after she was fired and accused in the 2009 CRCT cheating scandal won't be returning to the district.

Tuesday, an Atlanta Public School tribunal considered whether or not to renew Olivia Harris' contract. Harris was a third grade teacher at Peyton Forest Elementary School.

APS charged Harris with willful neglect of duties, immorality and violations of Atlanta Public School Board of Policies.

Attorneys told the tribunal that another teacher, Ms. James, said Harris gave her a copy of the test.

But Harris said James is lying.

"Do you have any reason or know of any reason why Ms. James would lie about this and tell them that you gave this document to her?"

"Well, Ms. James and I, we had confrontation when she was at Peyton Forest that one year and we didn't get along very well," said Harris.

Wednesday morning, the tribunal decided to uphold APS Superintendent Erroll Davis' recommendation to terminate Harris' job.
