No tour permit for site where teen was swept away

The tour company that led a group of teenagers on a Hawaii hike where a New York teen was swept out to sea didn't have a permit to be in the tide pool area where the incident happened.

The state Department of Land and Natural Resources said Monday that Hawaii Pack and Paddle has a permit to take kayaks to a specific spot in the bay and hike along a designated trail. But department spokeswoman Deborah Ward said the tide pool area falls outside the area covered by the permit.

The group of a dozen 14-and-15-year-olds had stopped to rest at the tide pool.

Waves washed away 15-year-old Tyler Madoff of White Plains, N.Y. and another 15-year-old. The other teen, from Miami was rescued and is recovering in a Honolulu hospital.
