FULTON COUNTY, GA (CBS ATLANTA) -

Robert Millam Cook, 44, faced a Fulton County judge on Wednesday. Cook is facing the death penalty. He's accused of the February 2010 shooting death of Chattahoochee Hills Police Lieutenant Michael Vogt.

"I was a daddy's girl and to not have him here is the hardest thing I've ever had to deal with," said Vogt's daughter Crystal McFarland. "I had a lot of pride in my dad. He was my hero."

Police said Vogt was investigating a suspicious vehicle when Cook shot him with a high-powered rifle before Vogt even got out of his patrol car.

"The only answer that we've gotten is that he didn't want to go back to jail," said McFarland.

There was a massive man hunt for Cook after the shooting. Investigators tracked him to his mobile home in Fairburn three days later.

CBS Atlanta News had the only news crew in court when Cook appeared for a motions hearing.
Some of the motions involved questions potential jurors will have to answer when the jury selection process begins.

The tough question McFarland and her family have - they want to know when the trial will get underway so they can get on with their lives.

"You put your life on hold. You keep living to an extent, but you put your emotions are on hold. You're waiting until you can finally have that closure. We are waiting for the trial and waiting for what we believe is the right verdict. We believe he is guilty and we believe he should get the death penalty," said McFarland.
