Police: Gwinnett County police officer arrested for soliciting a prostitute

GWINNETT COUNTY, GA (CBS ATLANTA) -

Gwinnett County police said an officer in their department was charged with pandering after he tried to hire a prostitute in Barrow County on May 31.

Police said Cpl. Brian Kelly did not tell Barrow County deputies he was a police officer at the time of his arrest, nor did he tell the Gwinnett County Police Department he had been arrested.

The Gwinnett County Police Department learned of the arrest on Monday.

"Officers in this agency are required by policy to immediately report an arrest to their supervisors," said Gwinnett County Police Cpl. Jake Smith. "As a result of Kelly's failure to report his arrest to this department, he was served with a letter of intent to terminate his employment."

Kelly resigned in lieu of termination Tuesday afternoon.

Kelly was employed as a police officer for Gwinnett County since October 2003. He served as a public information officer for approximately two years, ending in late 2010.
