Kamal Shelbayah, the owner of American Mattress Manufacturing Inc. in southwest Atlanta, has been ordered to make restitution to hundreds of customers for selling used mattresses as if they were brand new.
John Sours, administrator of the Governor's Office of Consumer Protection, said the office filed the order, which also requires Shelbayah to pay a $20,000 fine to the state.
The state launched its investigation into Shelbayah and his mattress factory after a CBS Atlanta News undercover investigation found mattresses produced by American Mattress Manufacturing contained filthy, moldy and smelly parts.
The beds also failed to meet federal flammability regulations in tests commissioned by CBS Atlanta News.
Kellee Johnson of McDonough said she purchased what she thought was a new bed from a dealer that advertised on Craigslist. Johnson learned that the bed was from Shelbayah's company after seeing CBS Atlanta's investigation last year. Johnson said she is glad to hear the state is cracking down on the mattress maker.
"I think they are getting what they deserve. They need to pay restitution. I think for us to work as blue-collar people to work hard, give them our money, it's time for them to pay up," said Johnson.
The court documents list 400 customers who are owed refunds by Shelbayah. The court order and list of customers can be found in a link to the right.
Sours said anyone who purchased a bed from American Mattress Manufacturing or one of Shelbayah's retail stores called Mattress 4 Sale should contact the Governor's Office of Consumer Protection by clicking here.
American Mattress Manufacturing is the subject of an investigation by the Consumer Product Safety Commission for alleged violations of federal flammability laws.
