Dunwoody day care trial enters day three of testimony

Posted: Updated:
DECATUR, GA (CBS ATLANTA) -

Thursday morning begins a third day of testimony in a high-profile murder trial.

Hemy Neuman has admitted he killed Rusty Sneiderman outside a Dunwoody daycare center in 2010. He has pleaded not guilty by reason of insanity.

Sneiderman's widow, Andrea Sneiderman, took the stand for a second day Wednesday. Neuman was Sneiderman's boss and alleged lover.

Prosecutors and defense attorneys again pressed Andrea Sneiderman about her relationship with Neuman. She has denied the two were having an affair.

"You said yesterday you shied away from him?" Neuman's attorney Robert Rubin asked Andrea Sneiderman.

"Sure," replied Andrea Sneiderman.

"Planning to go to a club, planning to go to a theater, going to a castle, is that your definition of shying away from him?" Rubin asked Andrea Sneiderman on the stand Wednesday morning.

"We all have different definitions," answered Andrea Sneiderman.

Rubin was referring to fun plans Andrea Sneiderman made for her and Neuman on a business trip to London. The trip was scheduled after Neuman had made advances to Andrea Sneiderman in person and via texts and emails.

The defense also asked Andrea Sneiderman about an email from Neuman in which he sent her electronic flowers.

"In your years in the business world, how often did your bosses send you flowers?" Rubin asked.

"Never, but I've never been stalked before," Andrea Sneiderman testified.

Prosecutors called several witnesses who had seen the pair together on various business trips in 2010.

"She was hugging him and they looked like a couple, groping and touching each other," testified Christine Olivera, who waited on Andrea Sneiderman and Neuman at a Greenville, SC, nightclub.

"They were having their own moment," said Olivera. "I didn't want to interrupt them, but they were kissing and being affectionate towards one another."

Various hotel employees testified the two asked for adjoining rooms on one business trip. On another, Neuman called the hotel and told the staff he and Andrea Sneiderman were newlyweds. He asked hotel employees to put flowers and chocolates in Andrea Sneiderman's room.

The final witness on Wednesday was Jan DeSilva, who testified he sold Neuman the gun used in the killing.

DeSilva said Neuman later told him something "bad" had happened and he threw the gun in Lake Lanier where no one would find it. DeSilva testified the defendant also asked him to lie if anyone asked him how he knew Neuman.

The trial resumes at 9 a.m. Thursday.
