A gunman has been charged with aggravated assault on an officer following a shootout with a Georgia State Capitol police officer.

Joseph Brian Gibbs, 39, from Griffin will be charged with two counts of aggravated assault on a police officer.

Officer Mark Edge is recovering at home after being grazed on the head by a bullet during Wednesday's shoot out.

According to the Georgia State Patrol, law enforcement received a LoJack alert on a stolen motorcycle and Edge responded to help.

As they approached the Gibbs in an alley the shooting began.

Several offices in a building were evacuated. The streets surrounding were closed off.

The bullet grazed Edge on the head and he and Sergeant Marvin Prince fired back.

Gibbs was struck twice in the abdomen. He is now in critical condition at Grady Hospital.

Investigators said they found several stolen motorcycles from the building off of Edgewood Avenue and Hillard.

Neighboring business owners said they had no idea there was any illegal activity going on in the building. They said they had no reason to suspect the motorcycles were stolen.

William Morrison used to live in an apartment on Hilliard Street near Edgewood right above where the shooting broke out.

“All that could have been avoided,” said Morrison.

A SWAT team swept in to search the alley after the shooting.

Morrison is amazed to hear the man accused in shooting did not obey the officers.

“All that could have been different he could have turned himself in and he wouldn't be in a situation you're in-wouldn't have charges pending against you,” said Morrison.

Two others could face other charges as the case unfolds.

There are also outstanding warrants for Gibb's his arrest in Volusia County, Florida.

On 7/18/2004 Mr. Gibbs was arrested by Daytona Shores Polic Department for Possession of Cannabis Under 20 Grams and Possession of Paraphernalia with a total bond of $1000.00.
