TUCKER, Ga. -- Charges won't be filed against an elderly man who shot and killed an intruder, according to DeKalb County police.

The apparent home invasion happened around 11 p.m. Tuesday at the 81-year-old man's home, which he shared with his wife.

The man told authorities he and the intruder wrestled for control of the gun, which belongs to the homeowner. The gun the went off, fatally wounding the suspect.

Authorities said the man was taken to a hospital to be treated for injuries he suffered in the incident.

Neighbors told CBS 46 News Wednesday that the intruder got involved with the wrong homeowner.
